Welcome to Pinnacle (the "App"), provided by Semestha ("we," "us," or "our"). These Terms of Use ("Terms") govern your use of the App. By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Pinn is a personal health and fitness companion that allows you to log meals and exercise, optionally analyze meal photos using AI, and receive local reminders. The App is provided free of charge at this time.

The App is intended for informational and educational purposes only. It is not a medical device and does not provide medical advice. Always consult a qualified healthcare professional for medical questions.

2. Eligibility and Accounts

• You must be at least 13 years old to use the App. If you are 13–17, you may use the App only with parental/guardian consent.
• The App does not require a traditional account; it uses a locally generated identifier. If we add account functionality later, you agree to provide accurate information and keep it up to date.

3. Permissions and Third-Party Services

• Certain features require your explicit permissions, such as HealthKit access, camera/photo library, and local notifications.
• Optional AI analysis is performed by external providers (OpenAI or Google Gemini) upon your request. By initiating AI analysis, you authorize us to transmit the selected content to your chosen provider to obtain results.
• Barcode lookups query Open Food Facts using the scanned barcode.
• Feature flags/experiments may be delivered by Statsig. No HealthKit data is shared with Statsig.

4. Acceptable Use

You agree not to:

• Use the App for unlawful purposes or to violate rights of others;
• Upload content that is illegal, infringing, invasive of privacy, harmful, or otherwise objectionable;
• Upload images of others without their permission or any sensitive personal content you do not wish to share;
• Interfere with or disrupt the App, its services, or networks;
• Reverse engineer or attempt to access the App’s source except where permitted by law.

We may monitor usage for abuse and may restrict or terminate access if we reasonably believe these Terms are violated.

5. HealthKit and Health Disclaimers

• HealthKit access is optional and requires your explicit consent. We only use HealthKit data to provide health/fitness features. We do not use HealthKit data for advertising or data mining unrelated to health.
• Data you enter or write to HealthKit via the App is marked as user-entered where supported.
• Always verify health information in the Apple Health app and consult professionals for medical advice.

6. Intellectual Property

The App, including software, design, graphics, and content, is owned by us or our licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

User content (e.g., photos you upload) remains yours. You grant us and our processors a limited license to use such content solely to operate and improve App features you request (e.g., AI analysis) and to comply with law.

7. AI Output and Accuracy

AI-derived nutrition estimates may be inaccurate or incomplete. Use them as approximations only. We make no warranty that AI outputs will be correct, complete, or suitable for any medical or dietary purpose.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) FIFTY U.S. DOLLARS (US $50) OR (B) THE AMOUNT YOU PAID, IF ANY, FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow the exclusion or limitation of certain damages; these limitations may not apply to you.

10. Indemnity

You agree to defend, indemnify, and hold harmless PT Semesta Hidup Bahagia and our affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or your violation of these Terms.

11. Changes to the App and Terms

We may update the App and these Terms from time to time. We will provide notice of material changes as required by law. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the App at any time for any reason, including if we reasonably believe you violated these Terms. You may stop using the App at any time. Sections intended to survive termination will continue to apply.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Indonesia, without regard to conflict of law principles. Where permitted, disputes will be resolved in the courts located in Jakarta. You and we waive trial by jury to the extent permitted by law.
